DOJ Agrees to $144M Settlement in Sutherland Springs Shooting Civil Cases Alleging Background Check Negligence

The Justice Department announced Wednesday it has reached a $144 million agreement in principle to settle civil cases stemming from a 2017 mass shooting at the First Baptist Church of Sutherland Springs, Texas, which left 26 dead. 

Officials said the settlements will resolve claims from more than 75 plaintiffs, who alleged "the Air Force was negligent when it failed to transmit to the National Instant Criminal Background Check System information about the shooter that would have prevented him from purchasing guns from a federally licensed firearms dealer." 

The gunman in the November 2017 attack, Devin Patrick Kelly, served in the Air Force. He died of an apparent self-inflicted gunshot wound.

The Justice Department said Wednesday that a "federal district court in Texas concluded that the United States was liable for damages caused by the shooting." 

Kelley had served nearly five years in the Air Force before being discharged in 2014 for bad conduct, after he was convicted of assaulting a former wife and stepson, cracking the child’s skull. The Air Force has publicly acknowledged that the felony conviction for domestic violence, had it been put into the FBI database, could have prevented Kelley from buying guns from licensed firearms dealers, and also from possessing body armor. 

Armed citizen hero:

Stephen Willeford, of Sutherland Springs, told KHBS on Monday that he heard gunfire coming from the First Baptist Church nearby, and knew that each of the gunshots he heard “represented someone, that it was aimed at someone -- that they weren’t just random shots, more than likely.”

Willeford, reportedly a former NRA instructor, decided to take action -- even though he “was scared to death.” He grabbed a “handful of ammunition” and began to load his magazine as he heard the “very rapid shots, just pop, pop, pop.”

Rules for thee, but not for me:

U.S. District Judge Xavier Rodriguez said in 2021 that had the government done its job and entered Kelley’s history into the database, "it is more likely than not that Kelley would have been deterred from carrying out the Church shooting." 

Twenty-six people were killed and 22 others injured when Devin Kelley stormed the First Baptist Church of Sutherland Springs, Texas. 

“You have the president of the United States talking to everyone about how we need gun control, we need to not get guns in the hands, and yet here he is, leading the charge with the Department of Justice to appeal the Sutherland Springs shooting case,” Texas attorney Thomas J. Henry said at the time.

Hunter Biden lied on Federal form 4473:

• Federal form 4473, or the Firearms Transaction Record, is a six-page form prescribed by the ATF that is required to be completed when a person buys a firearm from a licensed dealer.

  • Question 21 g. “Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?

  • Question 21 i. “Have you ever been discharged from the Military under dishonorable conditions?”

The punishment for false answers on form 4473 includes fines up to $250,000 and/or ten years of imprisonment.

In conclusion:

The Second Amendment to the Constitution:

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

(Hence, ALL gun laws are unconstitutional.)

• The government is clearly negligent in following the alleged laws it is supposed to enforce.

  • New York garage attendant Moussa Diarra confronts Charles Rhodie rooting around the garage with a bag, apparently attempting to steal some of the tools and equipment in the garage.

  • Moussa Diarra asked Rhodie what's in the bag and Rhodie pulls a gun and shoots Diarra twice.

  • In the struggle, Diarra gets the gun and shoots and kills Rhodie in self defense.

This is the same Soros DA who charged bodega worker Jose Alba with murder after he shot and killed a shoplifter who stabbed him.

• All the while Biden ramps up his efforts to disarm Americans, with his press secretary refusing to answer if Biden will order door to door gun confiscation!

Yet Biden himself admitted that that is exactly what he will do!
