8 U.S.C. § 1325 - U.S. Code - Improper entry by alien

Any alien who (1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or (2) eludes examination or inspection by immigration officers, or (3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under Title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under Title 18, or imprisoned not more than 2 years, or both.

How exactly are they crossing the border you may ask? One method is border agents violating their oath

Oath of Uniformed Officers:

I, [name], do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well an faithfully discharge the duties of the office on which I am about to enter. So help me God.

8 U.S. Code § 1324 - Bringing in and harboring certain aliens

(A)Any person who—

(i)

knowing that a person is an alien, brings to or attempts to bring to the United States in any manner whatsoever such person at a place other than a designated port of entry or place other than as designated by the Commissioner, regardless of whether such alien has received prior official authorization to come to, enter, or reside in the United States and regardless of any future official action which may be taken with respect to such alien;

(B)A person who violates subparagraph (A) shall, for each alien in respect to whom such a violation occurs—

(ii)

in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), be fined underoath to le 18, imprisoned not more than 5 years, or both;

(iii)

in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) during and in relation to which the person causes serious bodily injury (as defined in section 1365 of title 18) to, or places in jeopardy the life of, any person, be fined under title 18, imprisoned not more than 20 years, or both; and

(iv)

in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) resulting in the death of any person, be punished by death or imprisoned for any term of years or for life, fined under title 18, or both.

We keep hearing the mantra “the immigration system is broken”

Not one thought about protecting Americans from any possibly nefarious persons entering the country!

When actually Biden violated his oath by ordering ICE, CBP and CIS to NOT follow immigration laws

On Jan. 20, 2021, acting Department of Homeland Security (DHS) Secretary David Pekoske sent an operational memorandum to the leadership of U.S. Immigration and Customs Enforcement (ICE), Customs and Border Protection (CBP), and Citizenship and Immigration Service (CIS). This memorandum functionally ends all immigration enforcement and will result in dangerous criminals escaping justice and walking the streets.

We’ve seen the results ever since:

Over 20 million illegals have crossed our borders, costing over $400 billion per year.

Over 55% are military age men with many of them from countries hostile to the United States.

In 2021, U.S. Border Patrol agents apprehended 342 Chinese nationals. In 2022, 1,987. In 2023, it skyrocketed to 24,125, not including "gotaways" who made it past the Border Patrol.  

Still, nothing compares to what’s ahead. So far, this year’s numbers have already eclipsed 2023 with 24,296 arrests — and we still have six more months to go in the fiscal year. Chinese migrants are among the fastest-growing groups illegally crossing the southern border. Even more concerning, the overwhelming majority of these Chinese migrants are military-age males.

Violent gangs taking over parts of cities in America amazingly with little or no pushback from the cities or states they are in!

In 2023, 43,065 Americans died from gun related issues and the Biden administration would have taken all your guns if it could. In 2023, 74,702 Americans died from Chinese fentanyl alone, crossing our southern and northern borders. Over 150,000 if you count all the other drugs crossing the border! Apparently not a big deal to the Biden administration!

Acting ICE Director Patrick Lechleitner detailed how over 13,000 illegal immigrants in the US were found guilty of homicide and an additional 15,000 have been found guilty of sexual assault. Additionally, the letter stated that 435,719 criminal illegal immigrants are yet to be detained by authorities.

In New York and other blue cities, illegals are being placed in 5-star hotels and trashing them. Veterans are shamefully being evicted from assisted living to make room for illegals.

The Biden administration “has lost track” of over 400,000 children that have crossed the border and were supposedly in their care! These children were released to unvetted sponsors who have sexually assaulted them or killed them. Rep. Chip Roy relates in one instance, one hundred children were released to ONE SPONSOR IN A SINGLE-FAMILY HOME!

What ICE knows

In response to a request from Republican Rep. Tony Gonzales of Texas, ICE reported this summer that it has released 7.4 million such “non-detained” noncitizens into the U.S. during the last four decades or so. ICE reports that these include 662,566 noncitizens with criminal histories - 435,719 individuals with criminal convictions in their home countries and another 226,847 with pending criminal charges. These precise figures, however, do not say whether the crimes of the latter group were committed in the accused’s home country or the U.S.

The crime rate involving noncitizens is vastly understated

The Justice Department’s National Institute of Justice suggests that crime by illegal aliens who entered the U.S. by July 21, 2024, cost the country some $166.5 billion.

The problem is no one knows how many of the 5.4 million inadmissible migrants the Biden-Harris administration has released into the country are committing crimes. Nor does anyone know how many of the almost 2 million “got-aways” are committing crimes.

The absurd idea of “birthright citizenship”

The absurd idea that if you illegally make it across the border, like sliding into home plate, and have a baby, then it is automatically a United States citizen that can then bring in all its relatives. It completely ignores the actual meaning of the phrase “under the jurisdiction thereof”. The original understanding referred to political allegiance.

Naturalization—the idea of a foreigner becoming an equal citizen as if by nature—follows directly from America's political principles. Individuals have a natural right to emigrate from their homeland, but they may only immigrate to this country with the consent of the American people as expressed through U.S. laws. With that consent, a person of any ethnic heritage or racial background can become, in every sense, an American citizen.

What about those who are born here?

After the Civil War, the 14th Amendment (overturning, in part, Dred Scott v. Sandford, which said that no black could be a U.S. citizen) clarified the conditions of citizenship: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the States wherein they reside."

Being subject to U.S. jurisdiction meant, as then-Chairman of the Senate Judiciary Committee Lyman Trumbull stated, "not owing allegiance to anybody else [but] subject to the complete jurisdiction of the United States." The author of the provision, Sen. Jacob Merritt Howard of Michigan, pointed out that the jurisdiction language "will not, of course, include foreigners."

The act of crossing the border illegally clearly shows no allegiance to the United States or placing yourself “under the jurisdiction thereof”! Marching in the street with the flag of a foreign country clearly nullifies allegiance to the United States! Using this flawed logic, all the babies born to diplomats while in the U.S. would automatically be U.S. citizens.

It was in 1898 (in United States v. Wong Kim Ark) that the Supreme Court expanded the constitutional mandate, holding that the children of legal, permanent residents were automatically citizens. While the decision could be (and is often) read more broadly, the court has never held that the clause confers this citizenship on the children of temporary visitors, much less of illegal residents.

The broader reading is a constitutional misreading. Not only does it grant citizenship to the children of illegal immigrants, it also gives full due-process rights to the likes of Taliban fighter Yasir Hamdi (born in the United States of visiting Saudi parents and captured fighting U.S. soldiers 20 years later in Afghanistan).

But it is the principle of the matter that is most problematic. The broad claim of automatic birthright citizenship traces its roots more to the feudal concept of perpetual allegiance of subjects to kings, rather than equal rights and the consent of the governed. It violates bedrock American principles and undermines the rule of law.

Biden's big F-you “going away present” for Americans

On or around Dec. 1, 2024, the Biden administration is releasing an app full of glitches that will allow anyone in the world to apply online to get a number, unvetted, to enter the United States uninhibited and bypass in-person check-ins to their local ICE office!

18 U.S. Code § 111 - Assaulting, resisting, or impeding certain officers or employees

a) In General. —Whoever—

(1)

forcibly assaults, resists, opposes, impedes, intimidates, or interferes with any person designated in section 1114 of this title while engaged in or on account of the performance of official duties; or

(2)

forcibly assaults or intimidates any person who formerly served as a person designated in section 1114 on account of the performance of official duties during such person’s term of service, shall, where the acts in violation of this section constitute only simple assault, be fined under this title or imprisoned not more than one year, or both, and where such acts involve physical contact with the victim of that assault or the intent to commit another felony, be fined under this title or imprisoned not more than 8 years, or both.

(b)Enhanced Penalty. —

Whoever, in the commission of any acts described in subsection (a), uses a deadly or dangerous weapon (including a weapon intended to cause death or danger but that fails to do so by reason of a defective component) or inflicts bodily injury, shall be fined under this title or imprisoned not more than 20 years, or both.

(c)Extraterritorial Jurisdiction. —

There is extraterritorial jurisdiction over the conduct prohibited by this section.

President Trump's Border Czar, Tom Homan, has vowed to enforce immigration law, even in ridiculously called “sanctuary cities”, where elected officials who took an oath to uphold the Constitution and enforce the laws, think this time around Trump is bluffing. “We the People” have spoken! They better be prosecuted for defying the rule of law.

Now we have Trump Cabinet picks and appointees getting bomb threats and swatting attacks!

The Deep State and woke lunatics have become desperate. Cornered rats are dangerous and will do desperate things.

Among those targeted were New York Rep. Elise Stefanik, Trump’s pick to serve as the next ambassador to the United Nations; Matt Gaetz, Trump’s initial pick to serve as attorney general; Oregon Rep. Lori Chavez-DeRemer, whom Trump chose to lead the Department of Labor, and former New York congressman Lee Zeldin, who has been tapped to lead the Environmental Protection Agency.

Also threatened is Tom Homan, the new Border Czar who said, “he is not going to be intimidated. He will do his job.”

Homan said he hadn’t taken the threats seriously until realizing that others were now facing danger, noting his attitude has lately been “if you want something, come get some.”

But look, I’ve been dealing with this when I was the ICE director, in the first administration, I had numerous death threats. I had a security detail with me all the time. Even after I retired, the death threats continued. Even after I retired as the ICE director, I had U.S. Marshals protection for a long time to protect me and my family,” Homan said.

As I have explained, immigration laws are clearly in place and only need to be enforced

Title 8 spells out everything regarding aliens and nationality. There are no breaks in the system. It has just been haphazardly enforced, with purposeful and grievous violations by the Biden administration. Hopefully, we are turning over a new leaf.

Circling back to spending $400 BILLION a year keeping illegals housed, fed and in health care. While in North Carolina, Americans ARE LIVING IN TENTS IN THE SNOW!

This is beyond unspeakable considering the fact that FEMA has already been exposed mistreating Trump supporters!

One mother told Fox, “It's awful, especially with your kids. It feels like you're really letting them down. It's really cold. It's very uncomfortable.” And since many people lost both cars and homes in the hurricane, “and there's no money for many for porta-johns or bottled water,” Harrigan added, families are looking forward to a very bleak holiday season. “And when you talk to emergency workers here, they say the pace of recovery is just startlingly slow,” he added. One woman told him, “There's no sewer, there's no water, there's no power. There's your answer.”

Idiotic local bureaucracy over humanity

Government officials in Buncombe County, North Carolina, have begun forcibly evicting homeless individuals from “tiny homes” and cabins built and donated by the Amish community.

Around the beginning of November, hundreds of Amish carpenters traveled to Western North Carolina to build tiny homes and cabins where many people are still using tents for shelter.

These well-built structures were intended as temporary shelter, so people were not sleeping on the ground! Asinine local officials insist, for them to be “occupied”, they must have plumbing and electricity to comply with housing codes. Therefore, they are “unsafe.”

Critics, however, argue that this rigid enforcement does more harm than good. “The people living in these homes were safer and healthier than they would have been in shelters or on the streets,” said one housing advocate. “Why not work toward solutions instead of tearing down what’s already helping?”

Americans are kind and generous people

Despite not having access to the hundreds of billions of dollars in taxes confiscated from them and used for purposes they wouldn't have approved, Americans donate their time and their personal financial resources to those in need as is happening in North Carolina.

When Congress last addressed this issue comprehensively in 1986, there were approximately four million illegal immigrants living here. [In December 2005], it is estimated there are more than 11 million. We are a generous and welcoming people, but those who enter our country illegally, and those who employ them, disrespect the rule of law. And because we live in an age where terrorists are challenging our borders, we simply cannot allow people to pour into the United States undetected, undocumented, unchecked, and circumventing the line of people who are waiting patiently, diligently, and lawfully to become immigrants in this country.
