The Constitution of the United States
We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.
Article I Section 1
All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.
Notice that Agencies are not mentioned!
We the People of the United States:
Created the Constitution so are therefore ABOVE it.
The Constitution created the government, so is ABOVE it.
Therefore, when “Agencies” create “rules” they arrogantly and outrageously consider laws for the American people to follow and/or operate outside of laws that under the Constitution only the Legislature is able to make, they violate the Constitution.
Similar to the way the ATF arbitrarily decided adding a “bump stock” to a rifle made it a machine gun. Because Biden wants to look tough on guns, the ATF has now decided that adding a “pistol stabilizing brace” to a pistol makes it a rifle with a less than minimum 16” barrel length which is illegal.
Incidentally, On Jan. 6, 2023, the Fifth Circuit Court of Appeals has ruled that the Trump-era bump stock ban is a violation of federal law.
Detailed in a 296 page document:
Any weapons with 'stabilizing braces' or similar attachments that constitute rifles under the NFA must be registered no later than 120 days after date of publication in the Federal Register," read the rule, "or the short barrel removed and a 16-inch or longer rifle barrel attached to the firearm; or permanently remove and dispose of, or alter, the 'stabilizing brace' such that it cannot be reattached; or the firearm is turned in to your local ATF office. Or the firearm is destroyed.
Senate Republicans sent a letter to Attorney General Garland calling it:
the largest executive branch-imposed gun registration and confiscation scheme in American history.
Gun Owners of America say they will file a lawsuit challenging the new rule since there are possibly 10 to 40 million such braces used, including by handicapped or elderly Americans whose physical limitations make holding and aiming a pistol, especially for self defense, impossible any other way. Let's see. Taking away Americans God-given, not government permitted right to defend themselves. I see a HUGE Americans with Disabilities Act lawsuit brewing here.
SB Tactical gets hacked days before ATF announcement.
The most coincidental thing happened! SB Tactical, one of the most popular stabilizing brace brands in the U.S., having sold millions of braces, was hit with a data breach. Customer data, including names, addresses, and credit card information, was leaked online. A ready made list of potential felons complete personal data!
In other unconstitutional news:
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has been tracking gun owners without a warrant in a coordinated system with the FBI, according to documents exclusively reviewed by The Epoch Times.
Hundreds of pages of documents produced to Gun Owners of America from a Freedom of Information Act (FOIA) lawsuit show ATF agents telling the FBI to daily monitor specific people through the federal background system when they lawfully purchase guns.
They are basically tracking—without a warrant—every gun purchase by these people,” Rob Olson, an attorney for Gun Owners of America (GOA), told The Epoch Times. “There’s no legal process here. At best, this is highly questionable, if not outright unlawful.
34 U.S. Code § 40901 - Establishment
(i)Prohibition relating To establishment of registration systems with respect to firearms No department, agency, officer, or employee of the United States may—
(1)require that any record or portion thereof generated by the system established under this section be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or political subdivision thereof; or
(2)use the system established under this section to establish any system for the registration of firearms, firearm owners, or firearm transactions or dispositions, except with respect to persons, prohibited by section 922(g) or (n) of title 18 or State law, from receiving a firearm.
They are forbidden by Federal law, yet are actually monitoring people who buy guns and have not broken any laws.
If they had probable cause, they could seek a warrant from a judge, but they aren’t doing that,” explained Olson. “They are just deciding they have some reason to believe a certain person’s exercise of Second Amendment rights needs to be monitored. And it’s their own system so they make up their own standards. There doesn’t appear to be any oversight here.
In Delaware recently, two ATF agents and a Delaware state trooper showed up at a man's home, apparently without a warrant, in tactical gear, to demand he show them the two guns he recently purchased, because, according to the agent, purchasing more than two guns generates a red flag! So what exactly were they doing there? How did they know, since he broke no laws, was not forbidden to buy firearms, and purchased only two guns?
And yet, whenever a mass shooting is reported or a domestic terrorist attack happens, like the Boston Bombing, the FBI always tells us “we were watching them”!
A permanent surveillance system?
one of the newly released documents from the GOA’s FOIA that is buried in the hundreds of pages turned over by the ATF shows that there is no limit to how long the FBI will monitor a person’s gun purchases.
Apparently minorities are being targeted:
ATF records obtained by GOA and reviewed by The Epoch Times reveal that the suspects being monitored by the FBI are overwhelmingly minority. For example, out of 19 completed forms in March and April of 2021, only three people were listed as white. The races of the others being watched were black, Hispanic, and Asian. Two of the 19 were women.
Apparently income is also being tracked:
There is no legal limit on the number or monetary value of guns that can be bought. Nevertheless, a black woman in Arizona was “NICS flag approved” for being a possible straw purchaser because the agent reported her “income for 1st Qtr totals $1,948.67.” It’s unclear how the ATF knew the woman’s income. “Let’s expedite considering her criminal history and considering 9mm’s are weapons of choice for the cartel,” the special agent emailed NICS on Aug. 6, 2020. Much of the document is redacted.
A black woman in Ohio was put on NICS monitoring for at least 90 days in July 2020 due to her finances. The ATF agent wrote: “Permission for NICS flag, income is [redacted] for the quarter & she has spent over $8500 on firearms between 2/7-7/22″ and referred to an “attached ROI.” It is unclear how this alone provided sufficient cause to monitor this woman’s gun purchases.
How can they possibly know your income? Federal agencies that would know your income include the IRS, Social Security Administration and the Veteran's Administration. Are these agencies also involved in these illegal and unconstitutional activities?
Other Biden administration abuses of the 2nd Amendment:
A 500% increase in ATF shutting down Federal Firearms Licencees, (Gun dealers), for the least infraction, no matter how unitentional, without any warning whatsoever. Their records on gun sales and to whom guns were sold go into an unconstitutional ATF database to keep track of gun owners, which is estimated to be at least 6,000,000 by now.
Biden made so called “Ghost Guns”, (guns made from a kit), illegal. The regulations require that the main components used to manufacture ghost guns — the frames and receivers — be assigned serial numbers.

Federal agencies out of control for years.
The ATF, FBI, DOJ and other Federal agencies have been running rogue and overstepping their Constitutional authority for many years now. Having seen the evidence and reading the wise advice from our Founders, one can only conclude they are at war with the American people and their God-given right to defend themselves, which is codified in the Constitution. They continue with impunity to violate the Constitution. Even though as government entities, they are forbidden to do so.
Maybe the People's elected Representatives will hold hearings about the agencies Constitutional usurpations or something? Both sides will yell at each other for the cameras. When it's over, they'll all go and have a drink!
The only way, “We the People”, will save ourselves from this out of control government is to resist it! Michael Cargill, a Veteran and gun shop owner, was the Plaintiff who sued Attorney General Merrick Garland and Steven Dettelbach, head of the ATF over the bump stock/machine gun claim and won in the case I referenced near the top of this essay. The New Civil Liberties Association, (NCLA),
a nonpartisan, nonprofit civil rights group founded by prominent legal scholar Philip Hamburger to protect constitutional freedoms from violations by the Administrative State,
were his legal team.
Not to be confused with the American Civil Liberties Union, (ACLU), which is apparently too busy to defend American's civil rights because they are busy keeping the Southern border open and defending illegal border crossers.
I twice in this essay mention Gun Owners of America, (GOA),
a non-profit lobbying organization formed in 1976 to preserve and defend the Second Amendment rights of gun owners. GOA sees firearms ownership as a freedom issue.
They have legal teams that represent Americans across the country and as mentioned, are preparing to fight the ATF over declaring pistol stabilizing braces illegal, and continue to expose the unconstitutional practices of the ATF and FBI.
Judicial Watch Inc, who's motto is “Because no one is above the law”,
is a conservative, non-partisan educational foundation, which promotes transparency, accountability and integrity in government, politics and the law. They have filed thousands of lawsuits concerning government corruption, illegal practices, etc., and filed thousands of FOIA, (Freedom of Information Act) requests:
Judicial Watch obtained the only court ruling that President Bill Clinton violated the privacy rights of Kathleen Willey.
Judicial Watch and Judicial Watch alone uncovered the entire Chinagate scandal in 1995, starting with a Freedom of information Act request to the Commerce Department. Chinagate is the most serious scandal in U.S. history. It involves the transfer of America’s most sensitive technology, including but not limited to nuclear missile and satellite technology, apparently in exchange for millions of dollars in contributions to the 1996 Clinton-Gore re-election effort and the Democratic National Committee.
The Clinton-Gore Administration actually had the gall to offer to pay for all Judicial Watch’s legal costs (totaling about $2,000,000) if Judicial Watch agreed to drop its first Chinagate investigation and lawsuit. Judicial Watch refused this “blatant bribe” and “ramped up” its Chinagate investigations and lawsuits.
Judicial Watch’s suits proved Hillary Rodham Clinton was the mastermind of the Filegate scheme to where confidential “raw”, (unverified), FBI background information on Republicans and opponents of the Clintons “mysteriously were accidentally delivered” to the White House.
A federal judge has ordered former Secretary of State Hillary Clinton to sit for a sworn deposition for the first time in connection with her use of a private email account during her State Department tenure in regard to Benghazi, thanks to Judicial Watch's five year relentless pursuit and FOIA requests.
These are a few of the groups of American citizens defying government illegality and tyranny.
Biden administration's two-pronged attack on America:
While the Biden regime is busy trying to disarm the American people, it appears it is trying harder to disarm the military that is supposed to defend the country against foreign enemies by sending all their ammunition and equipment to Ukraine, the complete opposite of the Obama administration, which only gave Ukraine night vision goggles and blankets when Russia captured Crimea in 2014. Might the Biden family business dealings in Ukraine explain the complete turnaround? You do know the classified documents “found” after six years include those concerning Ukraine? Vice President Biden, who DID NOT have the power to remove or de-classify documents like a President, had taken classified documents marked " SCI", THE highest level of classified! You can only view them in the secure room in which they are stored! ALL electronic devices are collected, and a "white noise background" is created so listening devices can't intercept any conversation.
A great concern is that the U.S. is rapidly coming to a place where we would be in no shape whatsoever to engage China.
An excellent return on China's investment in the Biden family which began when Joe Biden and John Kerry took their sons Hunter Biden and Chris Heinz to China so their Rosemont Capital Company would be,
positioned to strike profitable deals overseas with foreign governments and officials with whom the U.S. government was negotiating,
could partner with the Chinese Central Bank in return for:
Legislation passed that benefited China.
Partnering with China gave China the cover needed to acquire American companies with sensitive technology that would have been unobtainable any other way.
Except of course when China flat out stole technology like the plans for the F22, F35, the Aegis Missile System, etc.
U.S. military resources are being depleted at an irreplaceable rate:
The U.S. has “pretty much run out of 155-millimeter Howitzers and 155-millimeter ammunition” after sending roughly 900,000 of the highly effective rounds to Ukraine.
And now:
The U.S. is moving roughly 300,000 thousand rounds of ammunition stored in Israel to Ukraine as stockpiles within the U.S. have dwindled to a critical rate, The New York Times reported, citing U.S. and Israeli sources familiar with the matter.
As of Oct. 14, 2022, the U.S. has committed $17.6 billion in security assistance since the Russian invasion. Since August, the Pentagon has withdrawn $10.5 billion in weapons and equipment directly from U.S. stocks via the president’s executive drawdown privilege.

Years of overuse, a lack of adequately trained maintenance personnel, not enough parts, inadequate and often dangerous storage spaces, and, in some cases, a lack of access to critical systems has combined to keep billions of dollars of Air Force and Navy aircraft from flying. This is according to a scathing Government Accountability Office investigation into the readiness of eight military aviation airframes.
So much for your threat of using F15’s on the American people Joe!
Biden is continuing the work Obama started when Obama fired 197 top military leaders including:
Gen. Carter Ham who was relieved as head of U.S. Africa Command after only a year and a half because he disagreed with orders not to mount a rescue mission in response to the Sept. 11, 2012, attack in Benghazi.
Rear Adm. Chuck Gaouette, commander of the John C. Stennis Carrier Strike Group, was relieved in October 2012 for disobeying orders when he sent his group on Sept. 11 to "assist and provide intelligence for" military forces ordered into action by Gen. Ham.
Many of the rest for a made-up reason or no reason at all.
The new focus of America's military:
President Biden said that the Pentagon told him global warming is “the greatest threat facing America.”
Not Russian hypersonic missiles, thanks to Hillary Clinton's State Dept./Clinton Foundation, the Podestas and the Obama administration scheme on behalf of Russia, called “Skolkovo”, a technology stealing arrangement with Putin. Or radical Islamic terrorists, North Korean or Iranian ballistic missiles, or the single biggest threat, China!
Also, we have military leaders not concerned that the U.S. military is the most feared in the world, but how not to offend someone by using the wrong pronoun!

In other words: We the People have a right to defend ourselves and our country if necessary and must be well trained to do either. As I previously stated, there are estimated to be over 400 million guns in the United States between police, the military, and American civilians. Over 393 million (Over 98%) of those guns are in civilian hands, the equivalent of 120 firearms per 100 citizens. A whopping 392,273,257 of those are estimated to be unregistered! The average gun owning American has 5 firearms, while nearly 22% of gun owners only have a single firearm.
Almost half the firearms in the whole world in civilian hands are in America! That is why you are (mostly), still walking around free!
Until recently, buying ammunition was not tracked. So, the amount of ammo potentially out there for the registered and unregistered guns is definitely astronomical!
Biden's DOJ, FBI and ATF would dearly love to locate every one of those firearms and all the ammunition, which makes it all the more import that they never do!
The Founders based everything on the people being able to:
defend themselves from criminals, especially now with Soros- elected DA's letting violent criminals right back on the street.
defend their country.
This right SHALL NOT BE INFRINGED, means any and all gun laws are unconstitutional!
In reading the wisdom from the Founders, you see their emphatic message that an unarmed population is defenseless and helpless.
Follow their advice. Keep your guns and know how to use them. If you presently do not own a gun, it is definitely time you got one and learn how to use it! With the military getting disarmed, someone is going to have to do defend you, your family and your country!
If that sounds ridiculous to you, the first thing Ukraine did when Russia attacked was pass out guns, actually machine guns, to the citizens, who were mostly not trained. You will already have a weapon and know how to use it. Your ancestors who founded this country were expert marksman. With a Kentucky type flint lock long rifle, which only had open sights, they could hit a target 300 or 400 yards away. The target was usually a British officer, throwing the rest of the troops in disarray. So much for a flint lock being an inferior weapon! And yes Joe, they did have cannons! They were ready to fight at “a minute’s notice”, hence, "Minute men". That is the citizen militia your Founders created.
Above all, resist the nefarious forces trying to disarm you!
Quite the compendium showing the usurpation of or Constitution. It is so infuriating how the machine keeps in chipping away with many people just giving up their freedoms. God save the USA.
If we lose our First Amendment rights, we will lose them all. Venezuela is a good recent example.
