How The Senate Has Betrayed America

By abusing its unique powers outlined in Article II, Section 2, Clause 2 regarding advice and consent of qualified appointees and not properly using the treaty clause

Biden said he was specifically choosing a black woman to fill a Supreme Court vacancy, which eliminated 99% of possible qualified candidates! Yet when asked to define a woman, one of two reasons she was sitting there, Jackson said she couldn't because she was not a biologist.

Blackburn should have asked Jackson if she didn't know what a woman was, what was she doing there in a confirmation hearing for a black woman?

Jackson sat on the board of Georgetown Day School. She was confronted by Senator Cruz with books from the school that taught Critical Race Theory. Incredibly, despite being a board member of the school, she claimed she wasn't aware it was in the curriculum.

Jackson claimed she was not an activist judge. Yet:

In the eight child-porn cases that came before her court, former D.C. District Court Judge Ketanji Brown Jackson heard horrifying details of “sadomasochistic” torture of young kids — including “infants and toddlers” — yet challenged the disturbing evidence presented by prosecutors and disregarded their prison recommendations to give the lightest possible punishments in each case, according to transcripts of sentencing hearings obtained by the Post.

In some cases, she even apologized to some of the kiddie-porn perverts for having to follow the statutes, which she called “substantially flawed.”

Over and over, the records reveal, Jackson made excuses for the sex fiends’ criminal behavior and cut them slack in defiance of investigators and prosecutors — and sometimes even probation officers serving her court — who argued for tougher sentences because the cases were particularly egregious or the defendants weren’t remorseful.

Despite these glaring examples of Jackson's lack of fitness that Senators heard during her confirmation hearing, especially the last ones, she was still shamefully confirmed to the Supreme Court by partisan politics and DEI!

How do we know she is not qualified?

During oral arguments for Murthy v. Missouri, Jackson apparently thinks that the government can violate the 1st Amendment and censor social media posts in “the most important time periods.”

Murthy v. Missouri concerns whether the federal government’s involvement in influencing content moderation choices at private social media companies, such as Facebook, YouTube, and X (formerly Twitter), violated the First Amendment’s Free Speech Clause. The case also addresses what individuals and entities are sufficiently aggrieved by the government action to meet constitutional requirements to have standing to sue in federal courts.

Update: Unfortunately, with an Amy Comey Barrett majority opinion, the Biden administration can violate the 1st Amendment regarding free speech by strong arming social media companies and using them as its pawn.

Another Ketanji Brown Jackson opinion. Snark included.

In the Harvard and North Carolina affirmative action cases, the Supreme Court majority ruled that affirmative action violates the Equal Protection Clause of the Fourteenth Amendment. Jackson had a sharply different and somewhat snarky dissenting opinion:

Tamika Montgomery-Reeves confirmed despite believing “implicit bias and identity threat” is in the courts

Former Delaware Supreme Court Justice Tamika Montgomery-Reeves was confirmed to the US Court of Appeals for the Third Circuit despite being co-chair of the Delaware Supreme Court Strategic Planning Committee that said to get rid of “implicit bias and identity threat” in the courts, the historic portraits of white judges who served on the court needed to be removed.

Should we be shocked? Apparently, qualifications are not important as long as all the boxes are checked

Another one of Biden's outrageous judge nominees that will probably get approved

Maine Superior Court Judge Julia Lipez to the United States Court of Appeals for the First Circuit just last year reduced by half, the sentence of Michael Smith, a man who molested two young girls, aged four and nine, from 12 to 6 years!

What I can say? This is a very tragic situation of a person who has a lot of good in him, a lot of good in him, having done a very… reprehensible thing to two young children, causing extreme damage.

He, (the President), shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

James Madison explained that the Constitution's framers considered the Senate to be the great "anchor" of the government. To the framers themselves, Madison explained that the Senate would be a "necessary fence" against the "fickleness and passion" that tended to influence the attitudes of the general public and members of the House of Representatives. George Washington is said to have told Jefferson that the framers had created the Senate to "cool" House legislation just as a saucer was used to cool hot tea.

The Founders had hope that only honorable Americans would serve their country as Senators, and in an unbiased and unpartisan fashion decide if Presidential nominees were qualified and fit to serve.

Again, apparently instead of qualifications, Biden appointees were to fill DEI quotas and were disgustingly approved by the Senate

Alejandro Mayorkas, incidentally, the first Latino and immigrant confirmed as homeland security secretary, 👏👏, actually told members of the House he had no clue of the status or whereabouts, of terrorists apprehended at the Southern border!

The depth of his treason would leave Benedict Arnold in awe! Over 12 million illegal invaders have been allowed to cross our Southern border essentially unimpeded and being bussed or flown into mostly red states and cities to manipulate populations. Many are military age men from countries that are our enemies like China and the Middle East. More than a few are pedophiles, rapists and murderers caught and allowed to go free to do it again. Michael Yon has seen Mayorkas on the ground in Panama actually coordinating the invasion!

Additionally, almost 400,000 illegals that we know about have been picked up all over the world in planes and released into the United States!

Fun fact: Recently, Tajikistani nationals with ties to ISIS and without proper documents were released into the U.S. with notices to appear in immigration court and released into the country! They were recently arrested in Los Angeles, New York and Philadelphia.

Pete Buttigieg as Transportation Secretary was another instance of just checking off the boxes

Pete Buttigieg, former Mayor of South Bend, Indiana’s 4th largest city, was picked over multiple officials with actual experience and a track record in transportation.

What was South Bend famous for during his eight years as mayor? A high crime rate and potholes. So many it put my home city of Pittsburgh in the minor leagues!

Transportation Secretary Pete Buttigieg defended being AWOL on paternity leave for two months amid the US’s crippling supply-chain crisis — while warning the upheaval could stretch into the holidays and beyond.

Yet, despite all the crisis going on that are his job, his major concern, taking into account an already obsolete and overloaded power grid, seems to be electric cars and installing charging stations, even where there is no electricity! Astoundingly, even a CBS host laughs in his face!

Regarding the Treaty Clause

It must indeed be clear, that the joint possession of the power in question, by the President and Senate, would afford a greater prospect of security, than the separate possession of it by either of them. - Federalist 75, Alexander Hamilton

The Senate stood on its head violating the Treaty Clause to approve the Iran Deal that Iran never even signed!

The Founders purposely set the bar high to approve treaties to keep the United States out of frivolous and/or damaging agreements and contracts with other countries.

Sadly, the U.S. has chosen to be derelict in its Constitutional responsibility and commit the United States to international agreements with legislative votes in both the House and Senate, rather than following the Founders prescribed method of submitting a treaty to the Senate for the advice and consent of 67 senators.

Senators Bob Corker (R-TN), and Ben Cardin (D-MD), concocted a devious plan. Subvert the Constitution and turn an agreement with another country, a treaty, into a bill with terms to be approved by the House and Senate, while giving Obama the ability to veto it. Then, 2/3 of the House and Senate would have to override his veto. Instead of 2/3 of the Senate approving it or it is null, and void and Obama has nothing.

This despite the fact Congress fully knew, and it was hidden from the American people, that Iran never signed any “deal”, nor was it approved by the Iranian Parliament, giving Iran full legal authority to do as it pleased!

The Joint Comprehensive Plan of Action (JCPOA) is not a treaty or an executive agreement, and is not a signed document,” wrote Julia Frifield, the State Department assistant secretary for legislative affairs, in the November 19 letter. (emphasis mine)

If it wasn't a treaty or executive agreement what the hell was it?

“The success of the JCPOA will depend not on whether it is legally binding or signed, but rather on the extensive verification measures we have put in place, as well as Iran’s understanding that we have the capacity to re-impose — and ramp up — our sanctions if Iran does not meet its commitments,” Frifield wrote to Pompeo. (emphasis mine)

Then Congressman Pompeo (R- KN), also stressed that JCPOA does not include the side deals signed between Iran and the International Atomic Energy Agency (IAEA). Nor was it signed by any representatives of the P5+1, (China, France, Russia, the United Kingdom, and the United States; plus, Germany).

Fun fact: Corker later voted against the Iran Deal vote he helped negotiate.

The Paris Climate Accord showed Obama's disdain for Congress

On March 31, 2015, months before COP-21, White House spokesman Josh Earnest was asked at a press briefing whether Congress has the right to approve the climate change agreement set to be negotiated at COP-21:

[Reporter]: …Is this the kind of agreement that Congress should have the ability to sign off on?

[Earnest]: …I think it's hard to take seriously from some Members of Congress who deny the fact that climate change exists, that they should have some opportunity to render judgment about a climate change agreement. (emphasis mine)

Which begs the question. “Without congressional ‘advice and consent,’ was the US ever officially in the Paris climate accord?”

The Obama administration didn’t submit the plan to the Senate as a conventional treaty. French Foreign Minister Laurent Fabius argued signers must agree to “a formula which is valuable for everybody and valuable for the U.S. without going to Congress.” - Chad Pergram

How treasonous of Obama! The President taking orders from the French Foreign Minister? How could something be “valuable for everybody” without the servants of the people, the United States Senators, having their Constitutional say on it?

Biden taking it upon himself to sign a ten-year defense agreement with a Ukrainian who cancelled their elections

Zelenskyy cancelled the Ukrainian national elections in effect making himself the dictator of Ukraine! So much for this war being about saving democracy in Ukraine.

U.S. Senators Mike Lee (R-UT) and Rand Paul (R-KY) blasted the Biden administration on Thursday for the president's recent decision to sign security guarantees for Ukraine — without review or consent from Congress — with a resolution making their case about the problems and risks that follow Biden's unilateral action.

Among other issues, the senators' resolution notes that "Ukraine is not a member of the North Atlantic Treaty Organization no party to a mutual defense treaty with the United States that has been ratified by the Senate" and highlights the fact that "the Biden administration has not provided Congress with a defined strategy or goals for United States engagement in Ukraine for more than 2 years."

And yet, the House and the Senate keep giving Ukraine more money and weapons!

Where is the rest of the Senate? More importantly, where is the House with Speaker Johnson telling Biden he can sign whatever illegitimate agreement he wants, with the money coming out of his pocket, not that of the American people, since the House holds the “Power of the Purse”.

Strange that even though Congresswoman Luna is being widely mocked as a ridiculous lunatic, from her website, June 22, 2024:

Attorney General Garland is now calling moderate Republicans, pushing them to vote against my inherent contempt resolution. This is the very definition of corruption. He believes he is above the law and can tell elected members of Congress what to do. My message to Garland is straightforward: release the tapes to Congress and let us listen to them. Why is Merrick Garland fighting so hard to keep these tapes hidden? What is on those tapes that is making him act in a criminal manner to protect Joe Biden? Any other American would be in jail for what he is doing. This blatant abuse of power must be stopped. The American people deserve integrity in our institutions, not political corruption.
